Fair Housing

Renter's Fair Housing Rights In Illinois and Federal Law

In Illinois, renters are protected from discrimination or unfair limitations under both state and federal fair housing laws. These rights apply when seeking to rent an apartment, home, condo, townhome, duplex, or other rental properties.

Illinois Fair Housing Protections

Under Illinois law, it is illegal to discriminate based on:

  • Race

  • Color

  • Religion

  • Sex

  • Disability

  • Familial status (having children under 18)

  • National origin

  • Ancestry

  • Age

  • Marital status

  • Military status

  • Sexual orientation

  • Gender identity

  • Order of protection status

  • Source of income, including Housing Choice Vouchers or other public assistance

In Chicago and other municipalities, renters may also have additional protections, such as protection against discrimination based on criminal history or other local factors.

Federal Fair Housing Protections

The Federal Fair Housing Act offers similar protections across the country. Under federal law, it is illegal to discriminate in housing based on:

    • Race

    • Color

    • Religion

    • Sex

    • Disability

    • Familial status (having children under 18)

    • National origin

Together, these state and federal laws ensure that all renters are treated fairly, without discrimination.

What Your Fair Housing Rights Guarantee

    • Equal Professional Service: Renters are entitled to receive the same quality of service from landlords and property managers, regardless of their protected characteristics.

    • Access to All Available Housing: Renters should be able to view and apply for any available housing they qualify for, without being limited based on race, national origin, or other protected characteristics.

    • No Geographic Limitations: Renters cannot be steered toward or away from certain neighborhoods based on race, national origin, or other protected traits.

    • No Discrimination in Pricing or Lease Terms: Renters must be offered the same rental prices, security deposits, and lease terms as other applicants.

    • Reasonable Accommodations for Disabilities: Renters with disabilities have the right to request modifications to their living space or adjustments to property policies (such as the installation of ramps or allowances for service animals).

    • Freedom from Harassment and Intimidation: Renters are entitled to a living environment free from harassment, threats, or intimidation based on their protected characteristics.

If you believe your fair housing rights have been violated in Illinois, you can file a complaint with the Illinois Department of Human Rights (IDHR) or the U.S. Department of Housing and Urban Development (HUD). These agencies will investigate claims of housing discrimination and provide avenues for enforcement and remedies.
